Service Area
E & K Heating & Air is based in Gwinnett County, Georgia, and provides services throughout the Atlanta, GA metro area. We serve clients located within approximately a 1-hour radius from our Loganville, GA location (zip code 30052).
Estimate Validity & Pricing

All estimates provided by E & K Heating & Air are valid for 14 calendar days from the date of issue, unless otherwise stated.

Acceptance of an estimate does not lock in pricing unless a deposit is received before the estimate expiration date.

If a deposit is not received by the expiration date, E & K Heating & Air reserves the right to revise pricing based on current rates, equipment costs, and availability.

We are under no obligation to honor expired pricing, regardless of when the estimate was accepted, unless payment was made prior to expiration.
Payment Terms

E & K Heating & Air accepts payment via check, credit card, cash, Cash App, and ACH transfer.

Payment for service calls, diagnostic services, maintenance visits, repairs, and other services is due on the same day the service is rendered, unless otherwise agreed to in writing by E & K Heating & Air.

Payment for a completed service call or diagnostic visit may not be withheld or delayed while a client considers additional repairs, seeks a second opinion, awaits a home warranty or third-party service provider, or decides whether to proceed with additional work.

Past-due invoices may be subject to collection activity and any remedies available under the applicable invoice, estimate, agreement, and Georgia law.

If E & K Heating & Air is subsequently authorized to perform recommended repairs or additional work, the original service or diagnostic invoice remains due as stated unless E & K Heating & Air has expressly agreed in writing to apply or credit that charge toward the additional work.

For estimates exceeding $1,000, a 50% deposit is due at the time of invoicing. Equipment and materials will not be ordered, and the project will not move forward, until the required deposit has been received.

The remaining balance on repairs or installations requiring a deposit is due upon completion of the work, unless otherwise stated in writing.

If a check is returned for insufficient funds, E & K Heating & Air reserves the right to require future payments by another accepted payment method.
Rental & Third-Party Properties

Payment for service calls, diagnostics, and repairs is the sole responsibility of the hiring client (property owner or manager), regardless of whether they are physically present at the time of service.

Payment is due the same day services are rendered and cannot be withheld, delayed, or conditioned upon tenant verification, home warranty approvals, or insurance payouts.

If an invoice remains unpaid after its due date, the client agrees that E & K Heating & Air may pursue all remedies available under the applicable estimate, invoice, agreement, and Georgia law. To the fullest extent permitted by law, the client agrees to pay reasonable costs of collection, including reasonable attorney’s fees, court costs, and collection agency fees.

E & K Heating & Air reserves all rights and remedies available under applicable Georgia law, including, where legally permitted, the right to pursue a claim of lien for unpaid labor, services, materials, equipment, or improvements furnished to the property.
Cancellation/Rescheduling Policy

Clients are asked to provide at least 24 hours' notice for any cancellation or rescheduling of service appointments.

No cancellation fee will be charged; this notice is requested for scheduling purposes.
Warranties:
Manufacturer Warranty

Full system installations include a manufacturer’s 10-year parts warranty.

Nest Learning Thermostats installed by E & K Heating & Air include a 5-year extended warranty (compared to 2 years at retail).

Nest Thermostats installed by E & K Heating & Air include a 3-year extended warranty (compared to 1 year at retail).

All warranties are subject to the terms and conditions of the manufacturer.

Unless otherwise stated in writing, manufacturer warranties generally cover replacement parts only. Labor, diagnostic charges, refrigerant, shipping, disposal fees, and any other costs associated with replacing manufacturer warranty parts are the responsibility of the client.
Workmanship Warranty
E & K Heating & Air stands behind the quality of our workmanship. If an issue arises as a direct result of our installation or repair workmanship, we will inspect the issue and, if determined to be the result of our workmanship, correct it at no additional labor charge.
This workmanship warranty does not cover:

Manufacturer defects or equipment failures

Normal wear and tear
-
Damage caused by misuse, neglect, lack of maintenance, or alterations made by others, or another contractor after E & K Heating & Air’s original service

Service calls unrelated to the original repair or installation

Property conditions
This workmanship warranty applies only to the original installation or repair performed by E & K Heating & Air.
Any workmanship warranty claim must be reported to E & K Heating & Air within a reasonable time after the issue is discovered. The client must give E & K Heating & Air a reasonable opportunity to inspect the system and determine whether the issue is related to E & K Heating & Air’s original workmanship before any warranty remedy applies.
Maintenance Plan

A Complimentary 1st-Year Maintenance Plan is included with full system installations, covering one Spring and one Fall preventative maintenance visit per installed system.

It is the client’s responsibility to schedule maintenance appointments. E & K Heating & Air will send email reminders during the Spring and Fall to prompt scheduling.
Limitations of Liability

Some installations may require access modifications or removal of existing components, including attic stairs, access panels, drywall, sheetrock, plaster, trim, or similar materials. Unless otherwise agreed in writing, E & K Heating & Air is not responsible for repairing, replacing, painting, or restoring such items when removal, access, or modification is reasonably necessary to perform the agreed HVAC work, except to the extent damage is caused by E & K Heating & Air’s negligent or willful misconduct.
Changes to Terms and Services

E & K Heating & Air reserves the right to update or modify these Terms & Conditions at any time. Any changes will apply prospectively and will be reflected by updating the "Last Updated" date above. The version of the Terms & Conditions in effect at the time a customer accepts an estimate or agreement shall govern that transaction.
Dispute Resolution

In the event of a disagreement, E & K Heating & Air encourages open communication to resolve matters amicably.

Both parties agree to attempt informal resolution before pursuing any legal action.
Entire Agreement

These Terms & Conditions constitute the general policies governing services provided by E & K Heating & Air. Additional terms, estimates, proposals, invoices, or signed agreements relating to a specific project shall take precedence where applicable.
